The Sex Offender Registration and Notification Act (SORNA) sets forth requirements for the registration and monitoring of convicted sex offenders. The SORNA authorizes the Attorney General to “specify the applicability of the requirements of [the SORNA] to sex offenders convicted before the enactment of [the SORNA] … and to prescribe rules for the registration of any such sex offenders.” The Attorney General made SORNA retroactive so that it applied to sex offenders who were convicted before the enactment of SORNA.Herman Gundy was convicted of sexual assault before the implementation of the SORNA. After being released from imprisonment, Gundy failed to register as a sex offender and was convicted for violating SORNA. Gundy appealed his conviction, arguing that it was unconstitutional for Congress to delegate to the Attorney General the power to “specify the applicability” of the SORNA’s registration requirements to sex offenders convicted before the SORNA was enacted. The district court and court of appeals ruled against Gundy, and the case was appealed to the Supreme Court.
