मेडिकल लापरवाही केस में ₹1.54 करोड़ के भुगतान का आदेश

The Supreme Court of India has directed the Indian Army and the Indian Air Force to jointly pay ₹1.54 crore as compensation for medical negligence to a former Air Force officer who contracted HIV/AIDS during a blood transfusion in 2002.

A Bench comprising Justice Ravindra Bhat and Justice Dipankar Datta held that the medical negligence of the Army and the Air Force led to the grievous injury suffered by the appellant. The Court also issued important guidelines for governments, courts, tribunals, commissions, and quasi-judicial bodies under the framework of the HIV & AIDS (Prevention and Control) Act, 2017.

The Court observed:

“The appellant is entitled to compensation of ₹1,54,73,000 on account of medical negligence of the respondents. Since individual liability cannot be fixed, the Indian Air Force and the Indian Army are held vicariously liable jointly and severally.”
