Hello, this video is about how to patent your AI invention. There's a recent significant rise of AI in innovations. AI patent filings have increased by over 100% in the last few years. According to the US Patent and Trademark Office, AI-related patent applications are up 33% since 2018 and appeared in about 60% of all technology subclasses in 2023. Of course, as we know, the boom year for AI is after 2023, so I would expect that this trend would be extrapolated into virtually all technology subclasses. The global AI market is expected to reach about 200 billion by 2025, driving the need to increase patents in the AI arena.

What are the challenges in patenting AI innovations? AI patents face unique hurdles due to their often abstract nature. AI is really a subclass of software, and software in the past three or four years has been subject to increased scrutiny under what is called the Alice patentability subject matter test. Roughly about 63% of all AI patent applications face initial rejections due to subject matter eligibility. The Alice test, established in 2014, has significantly impacted software and AI patentability. Post-Alice, there was a 31% increase in patent rejections in software-related inventions, and of course, AI is a part of software.
