Many Floridians believe that violating felony probation guarantees jail or prison time. A newer law, found in Florida Statute 948.06, says otherwise—under certain conditions, the judge cannot send you away. Notice I said "cannot." This is not a, well, maybe the judge could send you to jail. Nope. There's no discretion for the judge under certain violations of probation (VOP). First-time violators who didn’t commit a violent offense, whose violations are considered “low-risk” (like a positive drug test or missing a meeting), and who aren’t on community control may be immune from incarceration. The appellate case that highlighted this loophole proved judges don’t have as much freedom to lock you up as you’d think.
