Points for Discussion
• Cases instituted by:-
• Police report under section 173 Cr.P.C/Challan/Complaintcases.


• Foremost point, Court has jurisdiction or not.

• Supply of copies under section 265-CCr.P.C.


• Court shall deliver copies of statement by 161 Cr.P.C, 164 Cr.P.C and inspection not recorded by Investigation Officer on his first visit not later than 7-days before commencement of trial.

• Police report

• Provided, if any part of statement of 161 Cr.P.C is such that its disclosure to the accused would be inexpedient in the public interest, such part shall be excluded.

• In complaint cases , complainant shall submit in three days of commencement following documents;

• Copy of complaint/petition.

• Substance of accusation (copy of complaint, names of witnesses and gist of evidence).

• Provided that, if complaint is by Court or a public servant then these format lies are not required.

• Framing of charge (265-DCr.P.C)

• Sessions Court has to make opinion before framing of charge that;
i. There are grounds to proceed with the trial
ii. Peruse all the police report, the case, complaint and all other documents
iii. Statements filed by prosecution.

• Accused appears or brought for appearance.

• Questions (Have you heard and understood the charge?, Do you plead guilty?)


• Conviction of accused after pleading guilty.

• If accused admits the guilt/commission of offence, shall be recorded in the same words, if possible.

• If shows no sufficient cause, Courtmay convict him.

• Recording of prosecution evidence under section 265-FCr.P.C

• 265-J, statement recorded during investigation under section 164 Cr.P.C may be treated as evidence if, recorded in presence of accused and had given opportunity for cross-examination but not applicable practically.

• Prosecutor has to record statement for completion of evidence.

• Can prosecutor give up some witnesses or term won over?

• If apprehension that witness has become hostile.

अदालत में किसी अपराधी के विरुद्ध अपराध के आरोप की जानकारी से उसके निर्णय तक के समस्त कार्यवाही विचारण के कानूनी नाम से संबोधित किया जाता है। लेकिन अपराधों के लिए विभिन्न अदालतों में विभिन्न ढंग से विचार किया जाता है। लेकिन विचारण का एकमात्र उद्देश्य यही होता है। की समग्र जानकारी एवं साक्षो की रोशनी में न्यायपूर्ण निर्णय दिया जा सके। समानतया  7 वर्ष से अधिक की दंडा विधि वाले पराकरण सेशन न्यायालय द्वारा समय सुने जाते हैं।
