To convict an individual for the crime of DUI / DWI, "impairment" is not an element on the list of elements that the State must prove to convict someone of the crime of DUI.

To secure a conviction for a Marijuana DUI in Washington State, the State must prove xxx elements:

1. Date,
2. Jurisdiction,
3. The defendant was driving a motor vehicle, and,
4. The presence of 5 Ng/ml or more of THC in the defendant's blood.

That it! Notice this list does not include impairment. This is not to say that there can't be defense challenges to the evidence during the pendency of the case, but people don't want to be charged with the crime to begin with.

People who use on a daily basis will almost always be over the per se limit of 5 Ng/ml.

So, while marijuana may be "legal" in the State of Washington, this DUI attorney wants to get the word out about the real dangers of using legal marijuana.
