In this lecture, we discuss the salient (important) features of the Common Law Legal System in simple and exam-oriented language. The Common Law system mainly developed in England and later spread to many countries such as Pakistan, India, USA, and other Commonwealth states.
This video explains how judge-made law, also called case law, plays a central role in the Common Law system. You will learn about the principle of precedent (stare decisis), which means that courts follow previous judicial decisions in similar cases. This ensures consistency, fairness, and certainty in law.
The lecture also highlights the importance of judicial independence, adversarial system, role of judges and lawyers, and the flexible nature of Common Law. We also briefly compare Common Law with other legal systems studied under World Legal System.
