Here are 6 surprising facts about the E2 investor visa:

1. No Set Minimum Investment

Unlike many other investment visa programs, there isn't a legally defined minimum amount required for the E2 visa.

The investment must be "substantial," but what constitutes substantiality is evaluated on a case-by-case basis using an "Inverted Sliding Scale" where the proportion of the investment to the total cost of the enterprise is considered.

2. Indefinite Renewability

The E2 visa can be renewed indefinitely as long as the business remains operational and continues to meet the visa's requirements.

This means that while each entry into the U.S. under E2 status grants a maximum of two years, there's no cap on how many times you can renew your stay.

3. Dual Intent Not Allowed, Yet Green Card Possible

The E2 visa is considered a non-immigrant visa, and the U.S. Department of State does not officially recognize dual intent for this visa.

However, it's possible for E2 visa holders to adjust their status to permanent resident within the U.S. if they meet certain criteria or if they can gain sponsorship through employment or another visa category.

4. Spousal Work Authorization

Spouses of E2 visa holders can apply for employment authorization in the U.S., allowing them to work in any field, not just the business in which the E2 holder has invested.

This is a significant benefit not found with all visa types.

5. Applicable to a Wide Range of Businesses

E2 visas can cover a broad spectrum of business activities, from starting new ventures to buying franchises or existing businesses.

Even personal service providers, like legal professionals or consultants, can qualify if they invest in their practice.

6. High Approval Rates

The acceptance rate for E2 visa applications is relatively high compared to other nonimmigrant visas, especially if you're working closely with a competent U.S. immigration lawyer.
