Learn which California employee leave laws can be used if an employee has to miss work due to a quarantine or actual test positive for the Coronavirus. Karl Gerber, Workplace Lawyer explains California Sick Pay Law will not provide enough coverage because minimum quarantine periods are least 14 days, and persons who test positive may have to recover from symptoms and then test negative for at least 3 days. California employment lawyer, Karl Gerber, states the Family Medical Leave Act (FMLA) known as the California Family Rights Act (CFRA) in California will provide the best leave option for employees. Although the CFRA/FMLA provides up to 12 weeks of absence during a 12 months period, the legal protection only applies to employees who work for companies with more than 50 employees in a 75 mile radius. In addition, the employee must have worked at least 1,250 hours for the employer during the last year. Karl Gerber does not believe, at this time, the Corona Virus is a disability because luckily it does not seem to have long term health effects. Disabilities require a longer period of medical treatment and/or permanent disability. They believe the fact somebody tested positive or decided to self-quarantine cannot be kept from the rest of the workforce. There is a right to know which outweighs privacy interests.
