Freezing This Christmas is a charity single, raising money for pensioners who have had their winter fuel benefits cut by the Labour government...

So far this hasn't been played on BBC radio stations - but it's at the top of the Official Download list and could make it to the top of the main charts when they're announced at 4pm today.

However - despite being the most downloaded song, it hasn't actually featured in the main chart which takes into account things like music video downloads, CD sales and vinyl records.

The BBC has said its chart show on Radio 1 is a 'factual account of what the British public have been listening to'.

And a spokesperson has told us this morning that 'The BBC play a wide range of music across our stations - we don’t have specific policies on tracks or ban any songs. Decisions on what we play are always made with the relevant audiences and context in mind.'

Jeremy Vine on 5 is on television every weekday at 9:15am until 1:30pm on Channel 5.
