Plaintiffs to a lawsuit are required to have what's called "standing." Standing requires that a plaintiff be AFFECTED by a law or policy before challenging the law or policy in court. For example, the existence of a law or policy prohibiting filming on government building property AFFECTS all frauditors because it proscribes conduct that frauditors engage in. The EXISTENCE of the law or policy is what affects frauditors, not the later ENFORCEMENT of the law or policy on a specific frauditor. Frauditors have standing in court to challenge the existence of government policies prohibiting filming, and may not instead violate those policies.

A preenforcement action is an action, or lawsuit, filed BEFORE a law or government policy has been enforced on the plaintiff. A plaintiff to a preenforcement action simply declares to the court that the plaintiff would have otherwise engaged in the conduct proscribed by the statute or policy, and that the plaintiff cannot lawfully engage in the proscribed conduct until a court rules that the statute or policy cannot be enforced.

The reasons why frauditors don't file lawsuits, but instead film Youtube videos, is because one, frauditors are not activists trying to change anything, and two, frauditors know that they'll lose in court. While frauditors have standing to file lawsuits because frauditors are affected by government policies prohibiting filming, that doesn't mean frauditors are UNLAWFULLY affected. While frauditors have standing to FILE, their lawsuits are still FRIVOLOUS. The point is, there is a right way to lose - by filing preencforcement actions that will be dismissed as frivolous - and a wrong way to lose - by violating government policies, getting convicted of crimes, and filing lawsuits that will be dismissed as frivolous.

Some frauditors are so illiterate and unkowledgeable that they don't know that they must file lawsuits instead of violating policies. Other frauditors know that they can challenge policies in court instead of violating the policies, but are so illiterate and unknowledgeable that they don't know HOW. Like frauditors didn't know what the public forum doctrine was until I introduced it on my channel, frauditors didn't know what a preencforcement action was until this video. Unfortunately, I had to make frauditors a little smarter to make them look a lot dumber. I never mentioned preenforcement actions on my channel because I don't want to teach frauditors anything until it's too late.
