Like many people who bought their new-build home throughout the UK who were told that Public Open Space would be adopted by local authority only to be told at a later date the land is not to be adopted we wanted to raise the issue and ask the question is this fair?

Here in Yeovil we have estates paying both council tax and a rent or service or estate charge , yet only a few meters away you can enjoy lovely Public Open Space and only pay Council Tax! Some new build sites that happen to be on the upper end of the scale in terms of price have no rent charge.

Could the councils and government be doing more? New Developments are granted consent under condition there are large areas of publicly accessible land with the prior knowledge that unregulated management companies will apply a rent charge to the property. So what does this mean, well in short you must pay immediately on request any sums to cover maintenance which often includes very large Administration Charges. You have little power to object to such charges and failure to make payment will mean the rent charge owner can access your home removing you from it until any outstanding balance, interest and costs are recovered. This is happening on both Leasehold and Freehold homes. This raises the question, why are they called Freehold if they are certainly not "free of hold"? Are the councils allowing this to happen? Could they be doing more to help local residents? Should they at the very least be reducing the council tax bill for these residents who are paying already for some of the services others enjoy from their council tax bill?

We have even seen local councils setting up private grounds care companies to profit from maintaining the land they did not adopt for what ever reasons in the first place! Is this morally right? Why would the local authority want to profit from its residents who have no choice but to pay?

People should all be treated fairly when it comes to buying a home, why should one home owner pay Council Tax and Unregulated Uncapped Rent Charges for Maintenance Of Land Open to the general public, while others get to enjoy similar area's while only paying their Council Tax bill.
