In this video The Hindu Marriage Act 1955 is explained with reference to Section-13(B) Divorce by Mutual Consent.

Mutual consent should continue till the decree of divorce is passed. There can be unilateral withdrawal of consent i.e. consent once given to a petition for divorce by mutual consent may be subsequently withdrawn by any one of the two parties.

One of the parties may withdraw his/her consent at any time before the passing of the decree, even after expiry of 18 months from the date of filing of petition. 18 months time period is specified to ensure quick disposal of cases of divorce by mutual consent and it has no reference to the time for withdrawal of consent by the parties.

As provided in sub-section 2 of section - 13(B) the period of six months cannot be taken as mandatory, because if it is mandatory the very purpose of liberalised concept of divorce by mutual consent will be frustrated. Now the trend is to dispense with (waive off) the waiting period of 6 months in the interests of justice.
