COLORADO DUI: WILL I LOSE MY COMMERCIAL LICENSE

Commercial driver's licenses are regulated primarily by federal law under 49 CFR 383.5(1).

Federal law requires a minimum 1-year driver's license suspension for anyone who commits one of the following first offenses and many others under Colorado law:

-DUI,
-DUI per se,
-DUI drugs,
-Driving a commercial vehicle with a BAC of .04 or more,
-Refusing a DUI chemical test,
-leaving the scene of an accident, or
-driving without a current, valid license

The minimum suspension period increases to 3 years if you are transporting hazardous materials at the time of the violation.

A second or subsequent DUI and/or chemical test refusal results in a lifetime loss of your commercial driver's license.

However, if you are over 21 and you lose your commercial license, you may apply for a driver's license of another class or type as long as there is no other statutory reasons to deny you a license.

A state may reinstate any driver disqualify for life for offenses described in paragraphs B(1-8) in this section if that person has voluntary entered and successfully completed an appropriate rehabilitation program approved by the state.
