The case arose from the parliamentary election in Bushenyi District (Woman MP seat).

Sarah Bireete was the petitioning candidate who challenged the election of Bernadette Bigirwa, alleging electoral irregularities and seeking to have the election nullified

The High Court dismissed Bireete’s election petition, holding that she failed to prove the alleged irregularities to the required standard of proof and that her evidence did not sustain the claims made.

Bireete appealed the High Court’s decision to the Court of Appeal of Uganda.

In the appeal judgment, the Court of Appeal examined several grounds of appeal, including procedural issues like whether the respondents were properly served with the petition and whether the petition was properly presented.

The Court of Appeal upheld the High Court’s decision and dismissed Bireete’s appeal. This meant that Bernadette Bigirwa’s election remained valid.

Costs were awarded to Bigirwa after her victory in the appeal.
