Existing Privacy Governance Framework: This section briefly describe the existing legal and Regulatory framework which is in place to protect the privacy rights of users. These instruments are Constitution of Pakistan, Pakistan Telecom Act, Prevention of Electronic Crime Act, Draft Digital Pakistan Policy, Telecom Rules, Telecommunication Licenses and different Regulations for consumer protection etc. In very recent
Challenges and Gaps: All the existing legal and regulatory instruments in place dealing with the privacy of a user are with respect to Telecom users and all Telecom Licensed operators are obliged to comply with those. However, currently there are no instruments to protect the privacy of users in Digital ecosystem. Users are not well aware of what data of their is being captured and being used for what purposes in addition to what is required at the minimum for improving the quality and experience of service.
Proposal for way forward: There is an immediate need on part of Government and Regulators to come up with Legal and Regulatory framework for the protection of privacy of users based on principles of transparency, willful consent, choice and control. GSMA has done very good work in developing documents relating to user privacy and those principles can be adopted as those protect the privacy of users quite satisfactorily. Similarly OECD guidelines give good guidance on principles as well as national and International Implementation which can be adopted.
