DEADLINE FOR EUROPEANS TO APPLY FOR SETTLED OR PRE-SETTLED STATUS
As every person must be alert by now, the United Kingdom government aims for the United Kingdom to exit the European Union by 31 January 2020. This date is the most up to date delay to the initially scheduled exit date of 29 March 2019. In light of its previous dispositions, and the suggested end of free movement in the United Kingdom, the United Kingdom government planned and initiated the “European Union Settlement Scheme” in order to preserve the rights and residency status of European Economic Area and Swiss citizens in the United Kingdom after Brexit, and so that their position would be brought into line with all other migrants.

The recent date on which the United Kingdom government proposes to receive applications under this scheme was set at 31 December 2020, which is the termination of a transitional period after Brexit. This time limit would be prolonged to 30 June 2021 if the United Kingdom exits the European Union with a deal in position. Regardless of the delay in the withdrawal period, the termination of the transitional period has not been prolonged and the United Kingdom government has not shown any intent of extending their cut-off date.

Keeping in mind, if a European Economic Area or Swiss citizen has not submitted an application for status under the European Union Settlement Scheme in time, they may stumble upon themselves in violation of United Kingdom immigration law on 1 January 2021 or 1 July 2021, as the circumstances may be. It was earlier reported that if an individual neglects to submit a valid application by the appropriate deadline, immunities by the United Kingdom Home Office will only be permitted in a very restricted set of situations and only where these are sympathetic in nature.

If a European Economic Area or Swiss citizen discovers themselves in violation of United Kingdom immigration regulations, this may direct to significant problems for them in the future. They might be detained or even deported and any such immigration issues will impact their upcoming residence in the United Kingdom and their chances to apply for British nationality.

The United Kingdom government aimed for the European Union Settlement Scheme to be a smart and easy application for the majority of European Economic Area and Swiss nationals living in the United Kingdom. Nevertheless, defects in the structure have been observed on numerous instances. Vulnerable migrants, such as the aged or people in special needs, may be incapable to apply for one purpose or another, or would not be able to demonstrate their position with comfort. The United Kingdom government has not yet been able to sufficiently alleviate these apprehensions.
