It was a simple question.
Either yes or no.
If yes, I was going to ask what physical injury he suffered.

If no, I had a different reply for him.

He called asking for help.
He wanted to know if he had a good medical malpractice case.
He wanted to sue his doctor.

He wanted to sue the hospital staff as well.

I had to ask him four questions.
Simple questions.
Questions that would help me determine if his matter was timely.

Question that would immediately allow me to know what injuries he suffered because of any medical wrongdoing.

When I asked if he had a physical injury because of a doctor's carelessness, he said "Yes."

I then asked what physical injury he received.
"My head," he responded.
"What about your head? Head trauma? Head fracture?"

"No, they messed with my head," came his answer.
"No trauma. No fracture," he said.
I said "I can't help you then."

Without a physical injury, I cannot help you.
There are attorneys in New York who will take cases that involve only psychological and emotional injuries, but I am not one of them.
