In a landmark judgment delivered by the Rajasthan High Court in December 2024, custody of children was granted to a widow mother after it was found that the paternal grandparents had shown negligence in child care.
The father had passed away, and the mother was forced to leave her matrimonial home. The children remained with the grandparents, who refused to hand over custody.
The Court ruled in favor of the mother, emphasizing the best interest of the child, while granting visitation rights to the grandparents.

राजस्थान हाईकोर्ट ने दिसंबर 2024 में एक महत्वपूर्ण फैसला सुनाया जिसमें एक विधवा महिला को अपने बच्चे की कस्टडी दी गई, जबकि दादा-दादी को विजिटेशन राइट्स (मुलाकात का अधिकार) दिए गए।
पति के निधन के बाद महिला को ससुराल छोड़ना पड़ा, लेकिन बच्चे वहीं रह गए। दादा-दादी बच्चों को अपनी कस्टडी में रखने लगे।
महिला ने राजस्थान हाईकोर्ट में याचिका दाखिल की और कोर्ट ने माना कि दादा-दादी ने बच्चों की परवरिश में लापरवाही की है, इसलिए बच्चे मां को सौंपे जाने चाहिए।

यह फैसला यह स्पष्ट करता है कि बच्चों की भलाई (welfare of the child) सर्वोपरि है।
