Question of the Day: How do you prove you obtained a data subject’s consent under the GDPR?

The General Data Protection Regulation (GDPR) is an EU law that goes into effect on May 25, 2018. Companies must get consent from data subjects to collect or process their data, and be able to prove they obtained it.

For email lists, using double opt-in consent, is one way to demonstrate you obtained consent. If consent is obtained on a written declaration, it must be intelligible, with clear and plain language, on an easily accessible form, and distinguishable from other matters. You can’t bury the consent in your terms of service.
It must be as easy to give consent as to withdraw consent.

Failure to comply could result in millions of dollars in fines.
