United States v. Gardner | 107 F.3d 1314, cert. denied, 522 U.S. 907 (1997)

In United States versus Gardner, we’ll see whether the federal government had the right to own land in Nevada.

In eighteen forty eight, the United States and Mexico signed the Treaty of Guadalupe Hidalgo, which ceded land, including Nevada, to the United States.

Clifford and Bertha Gardner owned property in Nevada near Humboldt National Forest, a federally owned forest. In nineteen eighty eight, the U S Forest Service issued the Gardners a grazing permit in Humboldt Forest. In nineteen ninety two, a fire swept through the forest. The Forest Service reseeded the burned area and ordered that livestock couldn’t graze on the reseeded area for two years. The Forest Service notified the Gardners that their animals couldn’t graze in the forest in nineteen ninety three or ninety four. In nineteen ninety four, the Gardners allowed their cattle to graze in the forest. The Forest Service revoked the Gardners’ permit and assessed a fine for the unauthorized grazing. The Gardners refused to pay the fee.

The United States sued the Gardners for damages and sought an injunction to prevent any additional grazing. The district court granted summary judgment in favor of the United States. The Gardners appealed. The Gardners conceded that they grazed their livestock without a permit, and they didn’t contest the fine. Instead, the Gardners argued that Nevada should have title to the forest and other unappropriated lands in the state. The Gardners also argued that a clause in Nevada’s Statehood Act was unconstitutional.
