Supreme court in S.G. Vombatkere v. Union of India directed to keep all the pending trials in abeyance till the constitutional validity of the sedition law is not settled by the court.
Recently Law Commission in its 279th Report published on 24th May 2023 recommend against repeal of Section 124A of IPC and further suggested that enhanced punishment to be prescribed. Further stated that the said provision is constitutionally valid and not against Article 19(1)(a) of the Constitution of India.
