In this video, I’ll talk about how to sell a house through probate with the least amount of stress possible.

As you know, an Executor needs a Grant of Probate to sell a property.

When a loved one has just passed away, your mind is often not in the right place. With demanding, busy lives of stresses of work, managing children and home life, the last thing you need is to deal with the complexity of probate.
As an Executor, this is probably your first experience of managing an estate. Understandably, the uncertainty of how long probate takes to sell a house can cause anxiety.

It can take the probate office 2-3 months to issue a Grant of Probate or a Letter of Administration - if there is no Will.

How To Sell A House Under Probate?
Executors trust estate agents as their property experts. There are a few wonderful estate agents who are really good at what they do. But this is an exception rather than the norm. Here’s why.

If estate agents’ valuations were accurate, you wouldn’t need a RICS-qualified survey during a mortgage survey stage.

Estate agents aren’t the experts that they claim to be. Estate agents are brilliant salespeople, and their opinions on valuation can be wildly unrealistic to win your business.
Half of all sellers switch estate agents because their agent couldn’t sell their property, having wasted months of their time.
In our experience, probate properties can put off buyers for the following reasons:
1. Grant of probate delays – often, a Grant of Probate can take up to two months due to backlog at the probate office. Let’s say that your buyer instructed searches and obtained a mortgage offer, which is tricky given your inherited property might need some updating. Their mortgage offer is only valid for three months, and searches become invalid after six months. Therefore, they must obtain a new mortgage, re-apply, and go through stringent credit checks again.

2. Move-in date – your potential buyers might have a move-in date in mind to get their child into a particular school or a job relocation, or they have given notice to their landlord and must be out by a certain date. Even if they wait for a grant of probate with no confirmed date in sight, once you have obtained it, the conveyancing process can start. The current conveyancing timescales can be anything from 3 to 6 months to conclude once you have obtained a Grant of Probate.

3. Property Description Act – As an Executor, you will not have intimate knowledge of the house as the deceased did. If a professional Executor is managing the deceased estate, they will have an uphill battle to climb when answering queries raised by the buyer’s solicitor. You can be sued if you misled the buyer or provide incorrect information deliberately or otherwise. In the absence of clarity, a typical buyer’s mortgage company will not release funds, resulting in an abortive sale.
