On August 12, 2023, Florida Fish and Wildlife Officers were conducting water patrol along the IntraCoastal Waterway when they spotted a vessel traveling south with the operator clad in a wet suit. They decided to initiate a vessel stop both to check for resources and conduct a boating safety inspection.

Upon making contact with the operator, later identified as [REDACTED], the officers inquired about their catch for the day. [REDACTED] proudly displayed a lobster they had caught and revealed another lobster and a fish stored in a cooler near the helm. When questioned about any additional resources in the cooler, [REDACTED] mentioned a fish from the previous day. However, upon opening the cooler, along with the fish and additional lobster, the officers also noticed two empty alcohol beverage cans.

Further investigation revealed that the cooler did not belong to [REDACTED]. A search of the stern hatches led to the discovery of 25 empty alcohol cans and bottles in the starboard stern hatch. Concerned about the operator's sobriety, the officers requested [REDACTED] to board their vessel for a breath sample test to determine if they were operating the vessel under the influence.

[REDACTED] claimed not to have consumed any alcohol. However, subsequent breath tests using a Portable Breath Test (PBT) device yielded readings of .024 and .022 respectively, indicating a blood alcohol content above the legal limit.
