Defense attorney Stew Mathews says prosecution is "attempting to offer jury every opportunity to reach compromise verdict" in the case, which ended in a hung jury last year. Judge Leslie Ghiz says she didn't hear any testimony that supports reckless homicide and cites specific examples from Ray Tensing's interview. She says by case law she can't enter lesser charge if evidence doesn't show it. Ghiz said attorneys gave her heads up that they might request that so she deliberately paid close attention. She says prosecution had every opportunity to enter it before now.
