Democratic justices Christopher Donahue Kevin Daugherty and David Wecht face yes or no votes on their retention for another 10-year term. On November 4th this year's retention elections have drawn investment from major Progressive groups, and a conservative advocacy network tied to the state's richest resident and long-time Republican mega donor Jeffrey Yass.The Democrats who swept those races are now fighting for a second term. Judges up for retention don't face an opponent --voters simply choose whether to give them another decade on the court. With no candidates to combat the election rarely draws much attention and judges almost always keep their seats.This year the contest is different. Coming 7 months after a high profile vote in Wisconsin that maintained the Supreme Court's Progressive Majority despite heavy opposition and investment from Elon Musk, Pennsylvania's Supreme Court fight puts the spotlight on a year's long battle over the Judiciary and its role in abortion rights contentious elections and more.The Republican state leadership committees judicial fairness initiative has invested at least $118,000 in quote "No in November" unquote ads.The state GOP has said a no vote would amount to a term limit for justices whom they have painted as partisan activist or extremists after decisions related to the pandemic and elections.The Democratic legislative Campaign Committee plans to spend six figures as the American Civil Liberties Union and ACLU of Pennsylvania say they'll pump $500,000 into an effort educating voters on the quote unquote "pivotal" retention elections.The state democratic party said recently that Mega Billionaires are pumping money into this race to fill the court with extremists. The party noted that the elections will play a role in the makeup of a court who will oversee any legal challenge in Pennsylvania for the crucial 2026 and 2028 elections.Douglas Keith deputy director of the Judiciary Program at the Brennan Center for justice said quote "that speaks to this moment we're in".The overturning of Roe versus Wade by the United States Supreme Court in 2022 kicked the court races into high gear, Keith said.What I call a wow moment -- in a recent press call hosted by the Committee to Protect Healthcare, Pennsylvania doctors urged voters to support retention of the justices!The doctors describe the current States Supreme Court as a safeguard against federal and state efforts to curtail access to abortion and other reproductive healthcare. They also said the court could eventually rule on ongoing cuts the government funding for Central Medical Services and research.And to that I say, "for who illegal aliens?The impacts of retention elections vary from state to state. But in Pennsylvania should one or more of the justices lose their attention bids, Shapiro would appoint a Justice to fill a vacancy. The appointee would then have to be confirmed by the Republican-controlled Senate and a new Justice would be chosen for a 10-year term in a 2027 election.Since Pennsylvania adopted retention elections in 1968 voters have tossed only one Supreme Court Justice from the bench and that was Russell Nigro in 2005 after voters were angered by a pay raise for state officials.Christopher Nicholas a Republican consultant based in Harrisburg said that this is the first time in recent memory that there is quote "an active organized NO! on retention effort in the state.Nicholas goes on to say we have an organized and well-funded "vote no" operation and the political situation has changed here in two big ways. One Donald Trump is now President and leader of the Republican party and that wasn't the case in 2015. And two in 2015 there were 1 million more registered Democrats than Republicans and they're now essentially even.Also Nicholas points out that Shapiro's ad supporting a yes vote a month before the election may indicate Democrats think they are more behind the eight ball than they were! It's not something you usually go to the trouble and expense -- so they must think they need it.Conservatives had success in retention elections in Illinois in 2020 and Oklahoma last year.James Markley, the state GOP spokesman called the retention elections and amazing opportunity this November to remove three partisan activists Supreme Court Justices.Markley goes on to say that these are the same judges that locked us down during Covid and did irreversible harm the small businesses churches and our children's education. They broke election law numerous times to give an advantage to Democrats including allowing late and error-filled mail-in ballots to be counted.So the political lines are drawn. Time is now at hand. Today, Tuesday November 4th you can do your part by voting NO. Not once, not twice, but THREE times: Christopher Donahue Kevin Daugherty and David Wecht need to go. And a 10 yr. term limit on justices should be the absolute maximum.
