Convicted in a Cheque Bounce Case under Section 138 NI Act? Don’t worry — the law provides a clear process for appeal. ⚖️

In this video, Advocate Jinesh Soni (Defence Lawyer – Ajmer) explains the appeal procedure step by step:

✅ Trial Court: Cheque bounce cases are tried before a Judicial Magistrate.
✅ First Appeal: If convicted, your appeal lies to the Sessions Court under Section 374(3) CrPC.
✅ Deposit Requirement: Under Section 148 NI Act, you may need to deposit 20% of the fine/compensation before the appeal is heard.
✅ Second Appeal: After the Sessions Court, you can approach the High Court.
✅ Time Limit: You must file the appeal within 30 days of the Magistrate’s conviction order.
✅ Appeals Against Acquittal:

If the complainant wants to challenge an acquittal, they generally approach the High Court under Section 378(4) CrPC.

But after the Supreme Court’s ruling in Celestium Financial vs. A. Gnanasekaran (2025), even victims in cheque dishonour cases can appeal before the Sessions Court under Section 372 CrPC.
