The case is about a dispute between Mirasco and two insurance companies, American National Fire Insurance and Great American Insurance, over a rejected cargo of beef liver that was being shipped to Egypt. The Insurers added an endorsement to the Policy that excluded rejection coverage for IBP products shipped to Egypt. The shipment was rejected by Egyptian authorities, and the cargo was returned to Houston or Riga. During the return trip, some of the cargo was destroyed, and the rest was sold to traders and buyers in the United States at low prices. Mirasco settled claims with beef liver suppliers and Excel for the M/V Spero claim. The Insurers claimed that Mirasco filed a false claim and sought $932,000, which Mirasco disputed. The Insurers agreed only to pay for the return freight and deteriorated cartons but denied Mirasco's claim for settlements from Monfort and Excel.
