Can you get a trademark somebody else owns? It depends.Trademarks just aren't a blanket term where you have that word for all products and all services. Trademarks need to apply
to a specific product or service.

if somebody sells apples
with a certain trademark and another person
sells IPhones and laptops, then yes, you can have the same trademark
as the other individual. if the trademark holder sold laptops and you also wanted to sell laptops under that same trademark,
then no, you can't use that trademark.
