The consumer protection statute, Massachusetts general law is chapter 93A with respect to legal malpractice in Massachusetts. Hi, I'm attorney Neil Burns and I'm here today to talk a little bit about the consumer protection statute, which we use regularly when we have legal malpractice cases here in Massachusetts, the statute says it's a law.

The law says you have to reasonably describe the problem and outline the damages. What we do is we gather all the information about a client's case, the victim's case, and prepare a demand letter and send it to the offending attorney. His or her insurance company will respond. Now, what you need to know is the nuances of this.

First of all, the insurance company doesn't ensure the 93A damages. They ensure the negligence. So it's sort of a bark and a bite type of situation. If the bark is loud enough, they will look at it and see that they're gonna get bitten on the underlying negligence case. What is the deceptive part of it?

The negligence part of it is sort of clear. The lawyer blew the statute of limitations. The lawyer failed to get an expert witness. The lawyer didn't show up for a hearing or a trial and there was damages, but the deceptive part of it is what's not always clear, but we get all the time lawyers lie after a mistake.

That's essentially what happens. They send a letter that says we didn't make a mistake. Things are ongoing, or they send money saying we're taking care of it. Don't worry. We're settling this case. A whole host of things lawyers have done in our experience to cover up for, to deceive their clients.
