Entrepreneurs and startup founders should consider applying for an O1A visa for individuals with extraordinary ability in business.

Unlike most other U.S. work visas, the O1A allows for self-sponsorship if you establish a U.S. entity and can demonstrate a legitimate employer-employee relationship.

To qualify, you must either have won a major international award OR satisfy at least three (3) of the following eight (8) criteria:

1. You've received nationally or internationally recognized prizes or awards for excellence, which may include venture capital funding.

2. Membership in associations requiring outstanding achievements, which may include industry-focused communities or accelerator programs.

3. Published material about you in professional or major trade publications.

4. You've judged the work of others in your field.

5. Contributions of major significance to your field.

6. Employment in a critical or essential role at a distinguished organization, which may include the startup you founded.

7. High salary or other remuneration compared to others in your field.

8. Authorship of scholarly articles in major journals.
