Section 43 (Bare Act)
Where a person fraudulently or erroneously represents that he is authorised to transfer certain immoveable property and professes to transfer such property for consideration, such transfer shall, at the option of the transferee, operate on any interest which the transferor may acquire in such property at any time during which the contract of transfer subsists. Nothing in this section shall impair the right of transferees in good faith for consideration without notice of the existence of the said option.

Essential Ingredients
Fraudulent or erroneous representation of ownership.
Transferee enters into a contract, acting on that representation.
Transferor, later on, acquires interest in that property, while the contract is subsisting.
Transfer would operate on any such interest acquired, at the option of transferee.
Transfer must be with consideration.

In this case the basis of the rule of Estoppel stated by the Privy Council that where a grantor had purported to grant an interest in land which he did not at time possess but subsequently obtained, the benefit of his subsequent acquisition goes automatically to the benefit of earlier grantee. This means once the transferor acquires the interest in the property then the same will automatically transfer to the transferee

 Ram Bhawan Singh v Jagdish
In this case  court observed that “when a person having a limited interest in the property transfers a larger interest to the transferee on a representation, and subsequently acquires the larger interest, the larger interest passes to the transferee at the latter’s option

Jumma Majid v. Kodimaniandra Deviah

In this case, the S.C drew a distinction between Sec 43 and Sec 6 (a) of TPA.

Section 6 (a) (Spec Successions) provides that the chance of an heir apparent to succeed to the property of an intestate cannot be transferred. If the same is transferred, the transfer is void. So it is a rule of substantive law.
On the other hand Section, 43 makes the transfer valid at the option of the transferee if a person acquires the right in the property as an heir and the rest of the essentials are also fulfilled. It is a rule of estoppel.
