How to Convert Your MSME Samadhaan Case/Application from Temporary to Permanent Status ?

If you are a Micro, Small, or Medium Enterprise (MSME) struggling with delayed payments, then the MSME Samadhaan Portal is your first legal step for recovering your dues. However, one common issue many businesses face is that even after filing an application on the MSME Samadhaan Portal, their case does not automatically convert from ‘Temporary’ to ‘Permanent’ status. This means that your application is visible online but has not yet been formally taken up by the respective Micro & Small Enterprises Facilitation Council (MSEFC) for conciliation and arbitration.

Why Does This Issue Occur?
After submitting your online application, the Samadhaan Portal generates an Acknowledgement and marks your case as ‘Temporary’. However, the conversion to a Permanent Case Number is done manually by the MSME Facilitation Council in your district or state.
This conversion may get delayed due to:
a) Missing or incomplete documents
b) Non-submission of physical, signed, and stamped copies of invoices or purchase order.
c) Non-payment of prescribed processing fees (if any)
d) Non-submission of any additional information as required by your local MSEFC

Steps to Convert a Temporary MSME Samadhaan Case into a Permanent Case
1. Contact Your MSME Facilitation Council (MSEFC)
Reach out to the concerned Council office where your application is registered. You can find their address and contact details on the MSME Samadhaan Portal or your acknowledgment copy. Politely inquire if your application needs any corrections or additional documents.

2. Submit Required Physical Documents
Many MSME Councils ask for original signed and stamped hard copies of:
a) Invoices
b) Purchase Orders (POs)
c) Delivery Challans, if applicable

d) A covering letter explaining the claim / Statement of Claim
Make sure all documents are clear and in the prescribed format.
3. Fill the Prescribed Format/Checklist
Almost every Council has its own Prescribed Format/Application Form in which they verify your details and documents. Some councils also charge a small administrative fee for processing your case. Ensure you complete all formalities, submit the form physically or by post, and take an acknowledgment for your records.

4. Follow Up Actively
Do not assume that the portal submission alone is enough. Regular follow-up with
the Council is crucial to get your case converted to a Permanent Case and ensure it moves to the Conciliation Stage under Section 18 of the MSMED Act, 2006.

What Happens After Conversion?
a) Once your case is converted:
You receive an official Permanent Case Number from the MSEFC.

b) The Council issues a notice to the buyer party directing them to clear your dues or appear for conciliation.

c) If no settlement happens in conciliation, the case is automatically referred for Arbitration before the Council itself, and an Award/Decree can be passed for recovery along with interest as per the MSMED Act.
Simply filing online is NOT enough, Always ensure your documentation is complete, fees (if any) are paid, and you stay in touch with the Council office till your case is officially converted. This small but crucial step ensures your claim moves forward quickly and legally.
