The European Commission yesterday ordered U.S. tech giant Apple to pay Ireland the equivalent of $14.5 billion in unpaid taxes on its foreign profits.

Apple subsidiaries registered in Ireland hold intellectual property rights to the company’s products outside of North and South America.

Apple subsidiaries Apple Sales International and Apple Operations Europe are both registered in Ireland.

Around 90 per cent of Apple’s foreign profits are earned by these two companies and recorded in Ireland, the Financial Times reported. That figure includes all European sales, according to the Wall Street Journal.

However, until 2014, Apple paid only a tiny percentage of tax in Ireland before the majority of the profits were sent to Apple Sales International’s head office, which isn’t tax-registered anywhere.

This is in compliance with Irish law, but the European Commission claims this violates EU rules.

Apple said it will hold the $14.5 billion in escrow while it appeals the EU’s decision, according to the Wall Street Journal.
