Описание к видео Live in relationship certificate kya hota hai ?

There is no single, specific law that governs live-in relationships in India. Instead, their legal status and the rights of the partners are based on various judicial pronouncements and interpretations of existing laws. The judiciary, particularly the Supreme Court, has taken a progressive stance, recognizing live-in relationships as a facet of the fundamental Right to Life and Personal Liberty under Article 21 of the Indian Constitution.

While a live-in relationship does not automatically grant the same rights as a marriage, a woman in a long-term, committed live-in relationship can seek protection and maintenance under existing laws. For instance, the Protection of Women from Domestic Violence Act, 2005, includes a "relationship in the nature of marriage," allowing a woman to seek legal recourse for abuse. Similarly, courts have extended the right to claim maintenance under Section 125 of the Code of Criminal Procedure to women in such relationships, provided it is not a casual arrangement.

Children born from live-in relationships are considered legitimate and have the same right to inherit their parents' property as children born to married couples. However, unlike in a marriage, live-in partners do not have an automatic right to inherit each other's property without a will.

Landmark Cases Related to Live-in Relationships
The legal recognition of live-in relationships in India is a direct result of several landmark court judgments that have shaped the legal landscape.

S. Khushboo v. Kanniammal (2010): This was a crucial case where the Supreme Court unequivocally declared that a live-in relationship is not illegal or a criminal offense. The court affirmed that two consenting adults have the right to cohabit without societal interference, which is a part of their fundamental right to life.

D. Velusamy v. D. Patchaiammal (2010): This judgment was significant for providing a clear distinction between a "live-in relationship" and a "relationship in the nature of marriage." The court laid down certain conditions to determine if a relationship qualifies as the latter, such as the couple having lived together for a significant period, shared a household, and presented themselves to society as husband and wife.

Indra Sarma v. V.K.V. Sarma (2013): Building on previous rulings, the Supreme Court in this case clarified the different types of live-in relationships. It emphasized that while long-term relationships are eligible for protection under the Domestic Violence Act, casual or "walk-in, walk-out" arrangements are not.

Lalita Toppo v. State of Jharkhand (2018): This case further solidified the rights of women in live-in relationships. The Supreme Court ruled that a woman in a live-in relationship can seek greater relief under the Domestic Violence Act than what is provided under Section 125 of the CrPC, affirming the protective nature of the 2005 Act.
