On February 17, 2024, at approximately 5:15 PM, an officer with the Florida Fish and Wildlife Conservation Commission was on foot patrol in Holmes County, Florida, on a large tract of land north of Brake Road when an ATV was observed parked on a trail. The officer waited near the ATV until dusk, at which point an individual wearing camouflage and carrying a rifle emerged from the woods and walked to the ATV.
At this time, the officer announced their presence as a game warden and began a hunting inspection of the individual. When asked if any game had been taken, the individual stated that none had been. The officer identified the individual by a driver's license and observed a black bolt-action large-caliber rifle with a scope in the individual's possession, which was placed on the front rack of the ATV. Due to the hunting license being faded and not legible, the officer instructed the individual to drive a short distance, approximately one hundred yards up the trail, to where another officer and a patrol vehicle were located.
The officer walked ahead while the individual followed but hesitated for approximately 15 seconds before arriving at the vehicle. Upon arrival, the rifle was no longer on the ATV. When asked about the rifle’s whereabouts, the individual initially stated that it had been leaned against a tree and that they intended to retrieve corn from a truck to place at a stand. The officer then inquired whether the individual was a convicted felon, to which the individual admitted to having felony convictions.
At this point, the individual began raising their voice and behaving in a belligerent manner. The officer instructed them to place their hands behind their back and advised that they were being placed under arrest. While attempting to handcuff the individual, a sudden movement with the right hand was made, prompting the officer to back away and draw a weapon. No object was seen in the individual’s hand, and loud verbal commands were given to place their hands on the ATV and not to move. The individual was then handcuffed without further incident.
When asked about the rifle’s location and whether it had been thrown into the woods, the individual replied in the affirmative. The officer searched the area along the short stretch of trail where the ATV had been parked but initially could not locate the firearm. Upon further questioning, the individual denied knowledge of the rifle. A more thorough search of the area led to the discovery of a black rifle lying on the ground approximately 30 feet into the woods from the ATV’s previous location.
Due to the individual's efforts to conceal the firearm, an additional charge of resisting an officer without violence was added. A records check through dispatch confirmed prior felony convictions. The individual was taken to the Holmes County Jail without further incident.
