Cheney v. United States District Court for the District of Columbia | 541 U.S. 913 (2004)

In Cheney versus United States District Court for the District of Columbia, we’ll see whether Supreme Court Justice Antonin Scalia was required to recuse himself from a case involving his friend, Vice President Dick Cheney.

Judicial Watch, an activist group, and Sierra Club sued then-vice president Cheney in his role as chairman of the Energy Task Force. Judicial Watch and Sierra Club claimed that the task force violated federal law when it failed to make its committee documents public. After the district court and court of appeals denied the government’s request for summary judgment, the United States Supreme Court granted cert.

After the Supreme Court granted cert but before the Court heard the case, Scalia and Cheney went on a duck-hunting trip in Louisiana. Scalia had invited Cheney to join him on his yearly hunting trip months before the Court received the petition for cert. Scalia flew to Louisiana with Cheney on Cheney’s government plane. There were 13 hunters and other staff members on the trip. The group hunted with two to three hunters per blind, or small tent. Scalia and Cheney never hunted from the same blind and were never alone together during the trip, except for unintentional occasions. Neither Cheney nor Scalia discussed the case during the hunting trip.

Sierra Club filed a motion for recusal after it learned about the trip. Under the recusal standards for federal judges, Sierra Club argued that Scalia should recuse himself because there were questions about Scalia’s impartiality. In response, Justice Scalia issued a memorandum.
