I viewed this 60 Minutes seat back failure report at my Dearborn home on its original air date of February 16, 1992, and immediately bought a personal VHS copy.

Less than 4 months later I played the video at the Chrysler Technology Center (CTC) at a meeting of the Minivan Product Strategy Team (PST). Meeting minutes regarding the report and the PST comments were distributed to the internal Chrysler organization, mostly minivan personnel.

Less than 3 months later Virginia resident George Baird was killed in his Plymouth Voyager minivan was struck from behind, his seatback failed, and he lost control of the van, which was struck by an oncoming semi. Mr. Baird died instantly.

Three months later, in December 1992, Lee Iacocca appointed me to head the Safety Leadership Team (SLT).

On March 16, 1993 I once again played this February 16, 1992 60 Minutes seat back failure report; this time for the SLT. The SLT unanimously agreed to the following three items:

(1) NHTSA regulations were not protecting Chrysler customers in "real world" crashes.

(2) Hiding behind NHTSA regulations was not and would never be a viable legal strategy. (We were being sued and losing, what more evidence did the SLT need?)

(3) We agreed that we would begin our role of attaining minivan safety leadership by emulating in-part the words and philosophy of Mercedes-Benz ala Dr. Tom Bologa, that the "real world" was our starting point for our SLT safety recommendations to upper Chrysler management, and that the NHTSA regulations and the NHTSA process that created them were deficient.

These agreement items and the fact that the 60 Minutes seat back failure report was once again played at CTC was documented in meeting minutes which were distributed to Chrysler management,including but not limited to Executive Engineer Francois Castaing.

Within days of their receipt upper management demanded that the March 16, 1993 meeting minutes be "retrieved and destroyed." I was told that this directive came from Francois Castaing. Although I refused to comply with the "retreive and destroy" order, and kept two copies of the meeting minutes in my Chrysler office files, these and all other SLT safety files were confiscated by Chrysler Legal and Security staff while I was during the Christmas holidays of 1994, while I was out-of-town (note page 2).

In April 1995 I was interviewed by two representatives from NHTSA, and the above facts were presented to them.

In their opening defense motions of the death case of Baird vs. Chrysler, Chrysler lawyers openly and unabashedly claimed that no one at Chrysler CTC had ever seen the 60 Minutes video, that no one at in PST had ever seen the 60 Minutes video, that no one in the SLT had ever seen the 60 Minutes video, that I had never seen the 60 Minutes video, and that I did not have a personal copy of it.

The Baird case was hurriedly settled shortly after my deposition in July 1995.
