Hi, my name is Lauren Fields. I lead the Domestic Litigation team here at Roth Davies, LLC. Today I am going to be discussing negotiating a settlement during a divorce. Once a divorce is filed and temporary orders are figured out, the next step is to determine permanent orders. A lot of people think you file for divorce and then immediately you must go to trial to find out what will happen to your children, how your assets will be divided, and who is going to get stuck with the credit card debt. However, trials are the last step in a divorce process. Most of the time, divorces are settled outside of the courtroom by a negotiating settlement agreements. If you reach an agreement with your spouse, a Marital Separation Agreement is drafted and gets filed with the Court. This settlement agreement is a contract between you and your spouse and is typically about twenty to thirty pages long and will outline every detail of the divorce. The topics that are typically included in a Marital Separation Agreement will include child custody if applicable, child support if applicable, spousal support, asset distribution, and debt distribution. All of these issues can be negotiated outside of the courtroom. You and your spouse can reach agreements between yourself and have an attorney draft the paperwork. If that is not a possibility, your attorney and your spouse’s attorney can speak with each other to try to come to agreements.
