ডিজিটাল নিরপাত্তা আইনের-৩২ ধারা নিয়ে বিতর্ক দেখা দিয়েছে। আইনমন্ত্রী বলছেন,তথ্য প্রযুক্তি আইনের ৫৭ ধারার অপপ্রয়োগ রুখতেই ৩২ ধারা, সাংবাদিকতার সঙ্গে এ ধারা সম্পৃক্ত নয়। একই ধরনের মত দিয়েছেন সাবেক আইনমন্ত্রী ব্যারিস্টার শফিক আহমেদ। যদিও সংবিধান বিশেষজ্ঞ ডক্টর শাহদীন মালিকের মতে, এ ধারা গণমাধ্যমের স্বাধীনতা ক্ষুণ্ণ করবে।

তথ্য প্রযুক্তি আইনের ৫৭ ধারা নিয়ে ব্যাপক আলোচনা সমালোচনার পর, ডিজিটাল নিরাপত্তা আইন নামে নতুন আরেকটি আইনের খসড়ায় সোমবার অনুমোদন দেয় মন্ত্রিসভা। নতুন এ আইনে বিতর্কিত ৫৭ ধারা বিলুপ্ত হলেও ৫৭ ধারার বিষয়টি নতুন মোড়কে ৩২ ধারায় প্রতিস্থাপন করা নিয়ে দেখা দিয়েছে বিতর্ক।

বিতর্কিত এ ধারায় বলা হয়েছে, সরকারি,আধা-সরকারি, স্বায়ত্বশাসিত প্রতিষ্ঠানে বেআইনিভাবে প্রবেশ করে তথ্য উপাত্ত ইলেকট্রনিক যন্ত্রপাতি দিয়ে গোপনে রেকর্ড করা গুপ্তচরবৃত্তির আপরাধ। যার শাস্তি ১৪ বছরের কারাদণ্ড ও ২০ লাখ টাকা জরিমানা।
