The Los Angeles County District Attorney’s Office is committed to protecting the vulnerable, safeguarding public safety, and securing justice. That’s why Los Angeles County District Attorney Nathan J. Hochman appeared in court today on behalf of crime victims in Los Angeles County.

In a recent case before the court, a defendant, who had prior convictions for domestic spousal violence, was given mental health diversion earlier this year after being charged again with domestic spousal abuse, allegedly attacking his wife again.

Instead of the defendant having to face the charges being proven in court, a judge granted mental health diversion over the prosecutor’s strong objection. The mental health facility selected was not a locked facility but one where the defendant could leave. The defendant allegedly left that facility and is accused of violently and viciously assaulting his wife yet again earlier this month. He has been charged with attempted murder and injuring a spouse.

The county’s diversion and reentry program can be effective in providing rehabilitation for those who have behavioral, physical, and mental health issues. However, these programs often fail to protect victims and society when the offenders are repeat, violent offenders.

“Our mental health diversion system is appropriate for the right person—someone who has committed a non-violent, non-serious crime that could respond to treatment in a locked or in-patient facility,” said DA Hochman. “Putting violent people in outpatient facilities with a hope and a prayer defies all common sense. Such placements endanger public safety, and we’re going to stand up for victims each and every time.”

This case underscores the urgent need to ensure diversion programs are used responsibly and with the safety of victims and communities as the top priority.

Every charged defendant is presumed to be innocent until proven guilty beyond a reasonable doubt in a court of law.
