Sarah reviews what is general litigation and the process involved.

General litigation is the physical act of commencing a claim with the court. The legal representatives first see if an amicable resolution can be reached for both parties. If this resolution cannot be met, then a Statement of Claim is filed with the courts. Once this document is served to the other side, they will then file their Statement of Defense.

The next step is for each side to gather all documents needed for the case. This package is called an Affidavit of Documents. Both parties then exchange what has been gathered.
