There are around 80,000 actively practicing lawyers in the State of Florida, and not all of them are well trained or even ethical. So what do you need to prove to win a legal malpractice case?

To succeed in a legal malpractice case, you must prove:

(1) the existence of an attorney-client relationship;

(2) that your attorney either did something or didn’t do something they had a duty to do;

(3) that the attorney’s breach of that duty was a cause of damages; and

(4) That you did suffer damages.
