What's The Fine For A Trademark Violation?

While certain types of trademark infringement come with criminal penalties, most trademark infringements are a civil -- meaning non-criminal -- matter.

If you violate someone's trademark, likely the first thing that will happen is you'll receive a cease and desist letter. Then if you keep doing it, you may receive legal papers -- called a Complaint -- inviting you to respond in Federal court. If you get a Complaint, it has a time limit for you to respond, so you should seek legal advice right away!

What's the fine for a trademark violation? I'm answering a viewer question in the next two minutes. I'm Angela Langlotz, trademark and copyright attorney, and I go live here on weekdays answering viewer questions. So somebody wants to know what's the fine for a trademark violation? Well, fines are mostly like a criminal thing -- actually, they can be a civil thing, too.

But the federal government doesn't send people fines for trademark violations. For some sorts of really, really egregious trademark violations. There may be criminal penalties, however, 99% of the time, what's going to happen if you violate somebody's trademark is you're going to get a cease and desist letter in the mail, and it's going to say, hey, you're violating our trademark. Please stop. And if you don't stop, we're going to take you to federal court and make you stop.

So you should probably stop or maybe see an attorney if you're not sure that you should stop. But if you don't stop sometimes what's going to happen is you're going to get a summons, a complaint, asking you to come into federal court and defend your naughty infringement. So if you get something in the mail that looks official and it says it's a complaint and it has the federal court heading on it. Don't wait. Don't sit on it.

Don't put it in the garbage. Call an attorney because you're going to get in trouble. And what can happen is if you default and you don't respond, then it means the other side gets whatever they're asking for in the complaint. And it might be money. And so you might owe somebody money just because you defaulted and didn't respond.
