.08 BAC (blood alcohol concentration) is the DWI/DUI/OUI level in all 50 states. If you are .08 or more, there are "per se" laws in every state that say you are guilty of Driving While Under the Influence or Intoxicated. There is a new trend emerging out west and in my professional opinion about to creep east to legislate "per se" (quantify) marijuana laws. It is beginning, an opening of a door to a future where expert opinions will be needed in the Court room, and I think the trend will spread to other drugs.

Equating .08 BAC alcohol DWI with a 5 Nano gram THC DWAI (driving while ability impaired by drugs) is a scary bit of news. So many factors determine when someone is truly impaired by a drug. A blood number is not, and should not be the primary consideration.
