If an officer arrests you for a DUI, he or she will not un-arrest you if you blow under the legal limit. Once the officer develops the suspicion that you are under the influence of a substance and proceeds to arrest you, he or she cannot go back on this decision. He or she will then have to take a blood or urine test and wait for the results of your toxicology report. After that, you will be held in a jail cell where you can be monitored to allow you time to "sober up".

If your toxicology report comes back stating that you were not under the influence of drugs or alcohol, the state can choose to drop your DUI charges. Nevertheless, there will still be a DUI arrest on your record and the police report will still be available to the public. This cannot be removed unless your record gets expunged. Additionally, you will likely have problems with the Florida DMV and you may still be at risk of losing your license.
