1. What is Register Khasra Girdawari

WEST PAKISTAN LAND REVENUE RULES, 1968

Rule 39. Crop Inspection Register.- 42[(1)] For each estate, a crop inspection register
(Girdawari) shall be maintained, in Form XXIV.

43[(2) For each estate, a register of changes in cultivations, possession and rent to be known as the “Register Taghayyurat-e-Kasht” shall also be maintained by the Patwari in Form XXIV-A in which he will enter such harvest-wise changes as are not disputed and will incorporate the same in the Register Girdawari after due checking and attestation thereof by the Field Kanungo and the Circle Revenue Officer].

(Twice in a year)


a. If you enter into an agreement to purchase any land and get its possession
b. You are required to incorporate your possession/ cultivation in Revenue Record i.e in Register Khasra Girdawari, as well as register Taghurat kasth
Because
If later on, the seller refuses to transfer the land in your name or denies the execution of agreement to sell, in such case, your possession/ cultivation or entry in Register Girdawari will help you

a. How the entries in Register Khasra Girdawari carries importance? (2014 C L C 222)

The defendant/applicant in rebuttal, examined two witnesses. Although he denied to have signed the sale agreement, however he miserably failed to justify as to how the name of the plaintiff transpired in the "Khasra girdawari". His stand was that the said entries in the `khasra girdawari' are fictitious. If this was the position, then what prevented him to challenge these entries before the concerned Revenue Authorities. It is settled law that the presumption of truth is attached to the entries of the `khasragirdawari' register until and unless the same are proved to be fictitious and forged and, thus, cancelled by the competent authorities.

b. In what circumstances, the entries in Khasra Girdawari carries no importance (2010 Y L R 2526)

. Mere an entry in Register Khasra Girdawari by a Patwari does not confer any right because Patwari is a village officer who is inter alia responsible to keep the Revenue Record up-to-date and conduct harvest inspections twice in a year but he cannot change the possession. So, the change of possession by Patwari carries no-legal status unless it is also incorporated in register Taghayyar Kasht, which must be verified by the field Qanungo and countersigned by the Revenue Officer who is incharge of that revenue circle
