Hey, it's Mike DelSignore, I'm outside the Suffolk Superior Court, and this is the court you may find yourself in Boston if you're charged with serious bodily injury, potentially a fourth or fifth offense OUI.
So, how does a case get to Suffolk Superior Court? Well, if it's an OUI case, it would get here because the government seeks an indictment. Cases of OUI have what they call concurrent jurisdiction, meaning they could stay in District Court, which is probably a 10 minute walk down the street at 24 New Charter Street, or they can be brought here to Superior Court. When they're brought here, the potential sentence is higher, you can get state prison time, whereas, in district court, you can only get a house, essentially like a house of correction sentence.
So, when a case comes to Superior Court, it changes the ball game. You're looking at a higher sentence, but you also get a bigger jury. So, instead of getting a jury of six, you're going to get a jury of 12. The law, the cases, the law, the defense is still going to be the same. It's just going to be more at stake in terms of what you might be looking at as far as the sentence. Certainly, if they indict the case, you probably have a bad record and they're probably looking, you're looking at jail time.
So, if your case is in Superior Court, I've been in this court before. I've handled cases out of Superior Court, and sometimes you might have a case of a serious bodily injury, could be brought here. So, if the injuries are more serious, that could also lead you to Superior Court, as well as cases involving death also could potentially go to Superior Court. Let's say you have a death case, a motor vehicle homicide. That's a type of case where you're going to need an expert. You're going to need somebody who's experienced at doing those cases.
