Sub: Mercy petition cum representation and complaint against employer M/s
Abdul Aziz Al-Majid Est., P.O. Box 3782, Dubai, 9714-2664116, for illegally
withholding the huge amount of the undersigned due against the arrears of his
monthly salary and for issuing necessary directions to the ministry of External
Affairs for considering the said matter with Dubai Government in order to get
the salary amount of the undersigned released from the above stated employer
regarding the period of the employment of the undersigned with the said firm.
Most Respectful and Dear Hon'ble Sir,
The undersigned respectfully submits as under:-
01)-That the undersigned is an Indian resident, however he went to Dubai for
earning his livelihood and was assigned with the job of Quantity Surveyor in
the firm namely Ms. Abdul Aziz Al-Majid (hereinafter called with the name
Param only) for building projects under construction in Dubai City. A legal
labour contract in this regard was also executed and signed between the
undersigned as well as the above said firm and the period of employment was
specifically mentioned in the same starting from 15th June 2017 till 15th
September 2019 i.e. 27 months and the work of undersigned, which was
specifically mentioned for building project under construction in Dubai City
and the salary of the undersigned was to be paid by the said firm on monthly
basis i.e. an amount of DHS 15,000/- per month. As per the said contract, the
undersigned started his job from the period as specified in the contract
agreement in Dubai City only.
02)-That only after two months from the employment of undersigned, the said
firm directed him to do the Quantity Surveying work for building projects in
Sharjah and Ajman cities other than Dubai City with the further assurance &
promise to given the bonus or special allowance at the end of the year for the
extra work given to the undersigned. As per the assurance of the said firm, the
undersigned agreed to continue the additional work on the payment of bonus
or special allowance with regard to work done at the additional workplaces.
03)-That similarly after the expiry of six months of his employment, the said
firm again directed the undersigned to do the work of contract of Engineer and
Quality Engineer in addition to his earlier assigned work at the cost of
additional payment as the said work was totally different from the work as
mentioned in Legal Labour Contract. It is also very noteworthy to mention here
that the undersigned agreed to perform these additional works only on the
assurance of the firm and its employers that the undersigned will be given the financial benefits at the end of service contract like bonus or increased salary
package. The undersigned at that time also requested to the firm to give extra
transport allowance but at that time, the employer of the firm again assured to
give the benefits of transport allowance also at the ending of the service
contract executed between the parties.
. It is therefore respectfully prayed that a necessary action may kindly be taken
on this mercy petition of the undersigned as early as possible as the
undersigned is facing very hard days in India, being jobless and having a very
meager amount in his savings for his livelihood and further necessary
directions if required be also given to the Ministry of External Affairs to put up
the matter before the UAE government for its speedy disposal, so that the
amount illegally and wrongly withheld by the above stated firm be transferred
to the account of the undersigned, which is his hard earned money.
