illegal filling of ponds and unauthorised constructions. Section 17A(1) of the West Bengal Inland Fisheries Act,1984 [3] limits the area of water sought to be filled up. It also considers whether the said water body is capable of being used as a fishery. Only after considering such possibilities, is clearance for filling up of ponds granted. Further, Section clause (a) and (b) of the same provision prevents the conversion of a water body greater than five cottahs and capable of being used as a fishery. The National Water Policy (NWP) of 2002 faintly provided for prevention of encroachment of the small water bodies in India. The 2012 version if the policy is slightly better in terms of vocalising the need for conservation, development and management of ponds.
